This page states the "Terms and Conditions" under which user(s) (You/ Your) may use Billion Careers ("Website" or Platform) and the Mobile Application (App), an on-line service of Billion Careers Private Limited (Company/ Billion Careers) to provide Assessment, skilling , training and other related services for development which may help in prospective career opportunities. These Terms and Conditions include the Website Privacy Policy which is incorporated into these Terms and Conditions by reference.

Please read these terms and conditions carefully. If You do not accept the Terms and Conditions stated herein, please do not use the Website/App and its services. By using the Website/App You are providing your acceptance to be bound by these Terms and Conditions, including the Privacy Policy.

Users who violate these Terms may have their access and use of the Website/App suspended or terminated by the Company at its sole discretion.

1. ELIGIBILITY

You must be 18 years of age or older to visit or use the Website/App. By visiting the Website/App, You represent and warrant to the Company that You are 18 years of age or older, accepting these Terms and Conditions, and You have the right, authority and capacity to use the Website/App and agree to and abide by these Terms and Conditions. If minors wish to use the Website/App, their parents or legal guardian must acknowledge and agree to the Terms and Conditions. You also represent and warrant to the Company that You will use the Website/App in compliance with all the applicable laws and regulations.

2. USE OF WEBSITE/APP

Billion Careers authorizes You, to register and apply for the assessment, training the other services listed on the Website/App as a candidate after payment if specified fee subject to acceptance of these Terms and subject to the acceptance of terms of respective services subscribed by You. The contents of the Website/App such as designs, blogs, graphics, images, video, information, logos, button icons, software, audio files and other content (collectively, "Company Content") are the property of Billion Careers. Unauthorized use of the Company Content is strictly prohibited. You shall not modify the Company Content or reproduce, display, publicly perform, distribute, or otherwise use the Company Content in any way in any other manner that infringes Companys intellectual property rights.

3. WEBSITE/APP USE RESTRICTIONS

You shall not use Website/App in violation of any applicable law or regulation or in a manner that will infringe the copyright, trademark, trade secret or other intellectual property or proprietary rights of others or violate the privacy, publicity or other personal rights of others.

You shall not host, display, upload, modify, publish, transmit, update, distribute any material on the Website/App: a) that is grossly harmful, harassing, defamatory, obscene, pornographic, invasive of anothers privacy; b) threatening, abusive or hateful or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner whatsoever; c) impersonate another person or entity; d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of Website/App computer systems or Website/App Users, e) threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states or of public order or f) causes incitement to the commission of any cognizable offence or prevents investigation of any offence or insulting any other nation.

You are also prohibited from violating or attempting to violate the security of Website/App, including, without limitation accessing or logging into a server or account which You are not authorized to access; attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization. Violations of Website/App system or network security may result in civil or criminal liability. The Company will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations.

4. YOUR INFORMATION ON WEBSITE/APP

When You purchase/subscribe the service listed on the Website/App, You will be asked to provide certain information (your "Information"). The Company will disclose to any third party service provider your name, address, e-mail address or telephone number for providing the services and to the affiliated websites, platforms for job opportunity or career development related communications and to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant.

5. WEBSITE/APP PROHIBITED USES

The Company prohibits any use of Website/App: i) In violation of any applicable law or regulation, including but not limited to data protection and privacy laws or regulations governing the collection, processing, or transfer of personal information, or in breach of Website/App privacy policy; ii) Submit to Website/App any incomplete, false or inaccurate information; iii) Any attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of Website/App; iv) Aggregate, copy or duplicate in any manner any of the Website/App content; iv) Any use of the Website/App services for any unlawful purpose or any illegal activity, or v) post or submit any content, posting on the Website/App that is defamatory, offensive, vulgar, obscene, threatening, abusive, hateful, racist, discriminatory or likely to cause annoyance, inconvenience, embarrassment, anxiety or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind.

On any non-compliance to the above the Company may in its sole discretion, suspend or terminate the defaulting User's access to the website/App and or to remove or request the removal of the such offending content. The Company has the right to initiate appropriate proceedings against the defaulting Users in accordance with law.

6. USER CONTENT

You are solely responsible for your information, content, messages or other information ("User Content") that You submit, publish or display (hereinafter, "post") on the Website/App or transmit to other Users. By submitting/posting User Content to the Website/App, You automatically grant and You represent and warrant that You have the right to grant, to Company a license to use, copy, perform, display, and distribute such User Content. You also grant the Company and its affiliates the loyalty-free, perpetual, irrevocable, sublicense able, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the User Content. Company is not responsible for screening or monitoring User Content posted by Users on the Website/App. However, the Company may review and delete any User Content that, in its sole judgment, violates these Terms and Conditions, violates applicable law, rule or regulation, is offensive or illegal or in violation of these terms. The Company reserves the right to suspend Users and prevent their further access to the Website/App for violating the Terms and Conditions or applicable law, rule or regulations and the right to remove User Content which is in violation of the Terms and Conditions, abusive, illegal, or disruptive.

The following is prohibited User Content on the Website/App. The list below is for illustration only and is not a complete list of all prohibited User Content which: a) is implicitly or explicitly offensive, such as User Content that engages in, endorses or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; b) promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; c) displays or links to pornographic, indecent or sexually explicit material of any kind or provides or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from minors; d) provides instructional information about illegal activities or other activities, violating someone's privacy, or provides or creates computer viruses or pirating any media; and solicits passwords or personal identifying information from other Users;

The Company reserves the right in its sole discretion to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms and Conditions, including without limitation, removing the User Content from the Website/App and/or terminating the defaulting User's access to the Website/App and/or use Website/App services.

7. NO WARRANTY

Without limiting any of the other disclaimers of warranty set forth in these Terms, Company does not provide or make any representation as to the quality or nature of any of the Third-Party products or Services purchased through the Platform, or any other representation, warranty or guaranty. Any such undertaking, representation, warranty or guaranty would be furnished solely by the provider of the applicable class, or learning material, product or Service, under the terms agreed to by the provider.

The Company does not represent or guarantee the truthfulness, accuracy, or reliability of User Content or any other communications posted by Users or endorse any opinions expressed by Users. You acknowledge that any reliance on material submitted by other Users will be at your own risk. The Company has no obligation to screen User Content in advance and is not responsible for screening or monitoring User Content posted by Users. If notified by a User of communications which allegedly do not conform to these Terms and Conditions, the Company may in its sole discretion investigate the allegation and determine whether to take any action whether to remove or request the removal of the User Content. The Company has no liability or responsibility to Users for performance or of such activities.

7. REFUND POLICY

Amount/Charges for the consumer services are not refundable once the subscribed services have been provided.

In the event, due to any technical or other reasons attributable to the Company and/or its Service Provider, any non-provision or inability to provide the subscribed/purchased consumer services due to the reason of non-availability or cancellation of services, the Company will on the request of the concerned user/customer, refund the amount paid for the subscribed / purchased services.

8. MOBILE APP SERVICES

If You use the Website/App through a mobile device, You agree that information about Your use of the Website/App through your mobile device and carrier may be communicated to us, including but not limited to your mobile carrier, your mobile device, or your physical location. In addition, use of the Website/App through a mobile device may cause data to be displayed on and through your mobile device. By accessing the Website/App using a mobile device, you represent that to the extent you import any of your data on Website/App to your mobile device that you have authority to share the transferred data with your mobile carrier or other access provider. In the event you change or deactivate your mobile account, you must promptly update your Billion Careers account information to ensure that your messages are not sent to the person that acquires your old number and failure to do so is your responsibility. You acknowledge that you are responsible for all charges and necessary permissions related to accessing the Website/App through your mobile access provider. By using any downloadable application to enable your use of the Website/App, you are explicitly confirming your acceptance of the terms of the End User License Agreement and the Privacy Policy associated with the Application provided at download or installation, or as may be updated from time to time.

9. NOTIFICATION OF IPR INFRINGEMENT

The Company and all of our subsidiaries, associate and affiliated companies respect the intellectual property of others. Any unauthorized reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners rights. As a condition to Your use of Website/App, You agree not to use Website/App to infringe the intellectual property rights of others in any way. Billion Careers will terminate the accounts of any defaulting Users and account holders, and block access to Website/App who infringe of the copyrights, or other intellectual property rights, of others. Billion Careers reserves the right to take these actions at any time, at its sole discretion, with or without notice, and without any liability. If You believe that your copyrighted work has been uploaded, posted or copied to the Website/App and is accessible on such Website/App in a way that constitutes copyright infringement, please notify us at email at support@worqhub.com

Billion Careers makes no representations about the accuracy, reliability, completeness, or timeliness of the Website/App content/ third party services. The use of Website/App content is at Your own risk. Changes are periodically made to Website/App and may be made at any time. Billion Careers cannot guarantee and does not promise any specific results from use of the Website/App or Services. No advice or information, whether oral or written, obtained by a User from Billion Careers or through or from Website/App shall create any warranty not expressly stated herein. To the extent permitted by law, in no event shall Billion Careers be liable for the deletion, loss, or unauthorized modification of any User Content. Billion Careers does not provide or make any representation as to the quality or nature of any of the service through Website/App, or any other representation, warranty or guaranty.

Please note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, or people acting under false pretenses. You assume all risks associated with dealing with other users with whom You come in contact through the Website/App. By its very nature other peoples information may be offensive, harmful or inaccurate, and in some cases will be mislabeled or deceptively labeled. Billion Careers suggests that You will use caution and common sense when using the Website/App. As User authentication on the Internet is difficult, Billion Careers cannot and does not confirm that each User is who they claim to be. Because Billion Careers does not and cannot be involved in User-to-User dealings or control the behavior of participants on the Website/App, in the event that You have a dispute with one or more Users, You release Billion Careers (and our agents and employees) from claims, demands and damages (actual and consequential and direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes to the fullest extent permitted by law.

11. DISCLAIMER OF WARRANTY & CONSEQUENTIAL DAMAGES

THE COMPANY DOES NOT WARRANT THAT THE WEBSITE/APP WILL OPERATE ERROR-FREE OR THAT WEBSITE/APP AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. THE WEBSITE/APP AND COMPANY CONTENT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT POSSIBLE BY LAW, BILLION CAREERS DOES NOT WARRANT THAT THE WEBSITE/APP OR ANY WEBSITE/APP SERVICES WILL OPERATE ERROR-FREE OR THAT WEBSITE/APP AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE FULLEST EXTENT POSSIBLE BY LAW, IN NO EVENT SHALL BILLION CAREERS, OR ANY THIRD PARTIES MENTIONED ON WEBSITE/APP BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE WEBSITE/APP AND THE COMPANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT BILLION CAREERS IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WE DO NOT CHARGE / ACCEPT ANY AMOUNT EITHER AS REGISTRATION FEE OR SECURITY DEPOSIT OR OTHER FROM JOB SEEKERS DURING THE SELECTION / HIRING PROCESS OR WHILE INVITING CANDIDATES FOR SCREENING / INTERVIEW.

ON A PRECAUTIONARY NOTE, IN THE EVENT ON RECEIPT OF ANY JOB OFFER OR INTERVIEW CALL FOR ANY JOB OFFER IN THE COMPANY OR OTHER BRANDS, BILLION CAREERS SUGGESTS THAT THE CANDIDATE MAY TAKE SOME MEASURES SUCH AS VISITING THE OFFICIAL WEB SITE TO GET THE CONTACT DETAILS OF THE COMPANY AND OTHER BRANDS AND ENQUIRE WITH THE HUMAN RESOURCES DEPARTMENT OF THE COMPANY / OTHER BRANDS TO VERIFY THE GENUINENESS ABOUT THE INTERVIEW OR OFFER DETAILS AND OTHER RELEVANT INFORMATION.

13. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT POSSIBLE BY LAW, BILLION CAREERS'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH WEBSITE/APP OR YOUR USE OF THE COMPANY CONTENT, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), SHALL NOT EXCEED INR 500 OR THE ACTUAL PAID AMOUNT FOR THE SERVICE, WHICH EVER IS LOWER.

14. INDEMNITY

You agree to defend, indemnify, and hold harmless Billion Careers, its service providers, affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from) Your use of any Company Content, and Your breach of these Terms. The Company shall provide notice to You promptly of any such claim, suit or proceeding.

15. LINKS TO OTHER WEBSITES

The Website/App may contain links to third party websites. These links are provided solely as a convenience to You and not as an endorsement by Billion Careers of the contents on such third-party websites. You agree and acknowledge that when you access a third party website, the third party website is not controlled or supervised by Billion Careers and the Terms and Conditions and privacy policy of that website you visit will apply. By assessing links to third party websites, You acknowledge that the Company is not responsible for those third party websites and does not make any representations regarding the content or accuracy of materials on such third party websites. If You decide to access linked third-party websites and/or services, You do so solely at Your own risk

16. GENERAL

You agree not to assign Your rights or obligations under these Terms. You also agree not to make any unauthorized commercial use of the Website/App. Your access to Website/App is at your own risk and You are responsible for compliance with the laws of respective State" jurisdiction as may be applicable to You. These Terms and Conditions are governed by the laws of India, without respect to its conflict of laws principles. Jurisdiction for any claims arising under these terms shall lie exclusively with the Courts at Bangalore, Karnataka, India. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in an additional agreement, these Terms and Conditions constitute the entire agreement between You and the Company with respect to the use of Website/App and its Services.

17. REDRESSAL OF USERS GRIEVANCE

For any grievances of the users, the aggrieved users may submit their grievances by email at support@worqhub.com

18. REFUND POLICY:

In the event you (as a paid user) are not able to avail the subscribed services or products (post the payment to the company for such products or services), due to the reason that the subscribed services or product could not be provided beyond the control of the Company/concerned provider, you will be entitled to get refund of the amount excluding the GST amount which has already been remitted to the government. However, you are not entitled to any refund in case the products /services already provided/accessed by you. Refund consideration will be on case-to-case basis.

19. EFFECT OF TERMS AND CONDITIONS

These Terms and Conditions will remain in full force and effect while You are using the Website/App. The Company reserves the right, at its sole discretion, to pursue all of its legal remedies, upon any breach by You of these Terms. The Company may revise these Terms at any time by updating this web page. You should visit this web page periodically to review the updated Terms because the updated Terms are binding on You.

These Terms and Conditions including the Privacy Policy constitute a binding agreement between You and the Company, and is accepted by You upon your use of the Website/App.
